This Prenuptial Agreement (hereinafter referred to as the "Agreement") is made on this ______ day of ________________, 20____, by and between ____________________ (hereinafter referred to as "Party One") and ____________________ (hereinafter referred to as "Party Two").

WHEREAS, Party One and Party Two are planning to marry each other, and

WHEREAS, both parties wish to establish their respective rights and obligations regarding each individual's assets and debts, and the management of their financial matters during their marriage, in the event of separation, divorce, or death, in accordance with the State of Hawaii laws;

NOW, THEREFORE, in consideration of the forthcoming marriage, and in consideration of the mutual promises and covenants contained herein, the Parties agree as follows:

  1. Disclosure of Assets and Liabilities. Party One and Party Two each agree to fully disclose to each other their current financial status, including all assets and liabilities.
  2. Separate Property. Each party's premarital assets, to be listed in Exhibit A (Party One) and Exhibit B (Party Two), attached hereto, shall remain the separate property of the party who owned such assets before the marriage.
  3. Management of Financial Affairs. The parties may enter into joint tenancies or co-ownership of property acquired during the marriage, but such arrangements shall not alter the nature of assets defined as separate property unless expressly agreed to in writing by both parties.
  4. Division of Marital Property. Marital property, defined as any property acquired during the marriage that is not considered separate property, shall be divided in the event of separation, divorce, or death, as mutually agreed upon by the parties, or in the absence of agreement, in accordance with Hawaii Revised Statutes.
  5. Spousal Support. The rights to seek spousal support upon separation or divorce can be agreed upon by the parties and will be subject to the terms set forth in this Agreement.
  6. Amendment and Revocation. This Agreement may only be amended or revoked by a written document signed by both parties.
  7. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of laws principles.
  8. Entire Agreement. This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, agreements, or understandings of any kind.
